These adopted plans make up our development plan for Maidstone
Local plans must be consistent with national policy but the adopted local plan also takes on board local planning issues that are important to Maidstone.
The Maidstone Borough Local Plan provides a framework for development until 2031. It plans for homes, jobs, shopping, leisure and the environment, and plans for infrastructure to support these.
The policies within the plan will be used to make planning decisions.
We formally adopted our adopted Local Plan on 25 October 2017.

We formally approved our Community Infrastructure Levy Charging Schedule on 25 October 2017. It was implemented on Monday 1 October 2018. You can view it on our Community Infrastructure Levy page.
The Infrastructure Delivery Plan 2022 (IDP) accompanies the Maidstone Borough Local Plan. The IDP identifies the infrastructure schemes considered necessary to support the development proposed in the Local Plan and outlines how and when these will be delivered. The IDP is a “living document”, subject to regular review and therefore will build upon the emerging Local Plan Review.

The Community Infrastructure Levy (CIL) is a planning charge, introduced by the Planning Act 2008 which came into force on 6 April 2010 through the CIL Regulations 2010. It's a tool we can use to help fund new infrastructure to support the development of the borough. Most new development which creates net additional floor space of 100 square metres or more, or creates a new dwelling, is potentially liable for the levy.
Our Draft Charging Schedule was submitted for examination under Regulation 19 of the amended CIL Regulations 2010 on Monday 24 April 2017.
David Spencer BA DIPTP MRTPI from the Planning Inspectorate has been appointed to carry out an independent examination of our Draft Charging Schedule.
Louise St John Howe has been appointed as the Programme Officer.
She's an independent officer of the examination and works on the inspector's behalf, organising and managing the administrative and procedural matters of the examination process.

We consulted on our Draft Charging Schedule between 5 August and 16 September 2016. This set out the proposed charging rates for development in Maidstone, including the types of development that will have to pay the Levy and where the proposed rates will apply.
We consulted on our May 2016 Draft Regulation 123 List and Instalments Policy at the same time. This led to preparations for the consultation taking account of the comments we received during the 2014 consultation, and the development of our Local Plan and its evidence base.

We ran a consultation on our Preliminary Draft Charging Schedule between 21 March and 7 May 2014. This set out the proposed charging rates for development in Maidstone, based on our Maidstone Borough Local Plan 2014. Maidstone Borough Council made a Non-Immediate Article 4 Direction for the Primary Shopping Area on 17th March 2022. This means planning permission will be required for change of use from Class E (commercial, business and service) to Class C3 (dwellinghouses) of any land or buildings shown on the maps attached to the Directions after it comes into force.
However, these were not confirmed by the Department of Levelling Up, Housing and Communities and have now lapsed.
Maidstone Borough Council made Non-Immediate Article 4 Directions for a number of individual office buildings on 17th February 2022. This means planning permission will be required for change of use from Class E (commercial, business and service) to Class C3 (dwellinghouses) of any land or buildings shown on the maps attached to the Directions after they come into force.
However, these were not confirmed by the Department of Levelling Up, Housing and Communities and have now lapsed.

This means that planning permission will be required for change of use from Class B1(a) (offices) to Class C3 (dwellinghouses) of any buildings shown on the maps attached to the Directions. These directions came into force on the 9th November 2020 but will ceased to have effect from 1st August 2022.
